Assignment Title: Hiring a Firm for Technical Assistance to conduct a detailed assessment of the gaps in the enforcement regulatory framework for a competitive, open-access broadband market

The Government of Maldives (GoM) has received financing from the World Bank toward the cost of the Digital Maldives for Adaptation, Decentralization and Diversification (D’MADD) Project, and intends to apply part of the proceeds for consulting services.

The Consulting Services (“the services”) is to establish a comprehensive monitoring and reporting framework for the Communications Authority of Maldives (CAM), ensuring that the infrastructure and service providers fulfil their commitments. This involves identifying the necessary resources and equipment, including training required for the personnel to operate such equipment to enable consistent monitoring of broadband services throughout the country. Additionally, the assignment includes developing and updating regulatory frameworks to promote open access and fair competition in the telecommunications industry. Furthermore, recommendation of detailed capacity building programs would need to be designed and implemented to enhance the oversight and enforcement capacity of CAM staff, enabling effective regulation and monitoring of the sector.

 

The Ministry of Climate Change, Environment and Energy (MoCCEE) now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria are: i) Minimum five (5) years of proven experience related to telecom planning and transformation programs supporting quality of service (QoS). Additionally, the firm should have been involved in crafting strategies; policies; legal, regulatory and competition frameworks. ii) Minimum of three (3) successfully completed projects related to assessing and monitoring QoS of the Internet. iii) Minimum of one (1) successfully completed project related to developing regulatory frameworks for enforcing QoS of the Internet

Key Experts will not be evaluated at the shortlisting stage. However, Firms are required to clearly state the proposed position for each Key expert proposed.

The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” Fifth Edition dated September 2023 (Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest. 

Consultants may associate with other firms to enhance their qualifications, but should indicate clearly whether the association is in the form of a joint venture and/or a sub-consultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.

A Consultant will be selected in accordance with the Quality and Cost-based Selection. (QCBS) method set out in the Procurement Regulations.
